EXECUTIVE BRANCH

Governor’s Office

As a former employee and trusted advisor for Attorney General Jay Nixon, now Governor Nixon, Richard McIntosh works closely with the Governor and the highest levels of his policy making staff.  On State contractual issues, Richard works on behalf of clients who have innovative, cost saving ideas which provide the means for the Governor to achieve his policy goals with budgetary efficiency.  We have access to one of the state's premier administrative law attorney's who understands the administrative rules process.  At Flotron & McIntosh we treat our client favorably with regard to administrative actions and adopt favorable positions on administrative rules.


At Flotron & McIntosh, we work to influence the Governor’s office to:

  • Incorporate our clients’ interest into budget proposals;
  • Consider our clients’ interest in legislative recommendations;
  • Sign beneficial contracts with our clients;
  • Sign bills into law that benefit our clients, and the state;

State Agencies and Bureaucrats

The Missouri Legislature grants state agencies the latitude to interpret portions of state statutes.

At Flotron & McIntosh, we understand these regulatory issues and strive to:

  • Ensure interpretations of statutes are appropriate for our clients;
  • Prohibit state bureaucrats from over-reaching in their rule making authority to our clients’ detriment; and
  • Defend clients’ contracts from state agencies that make inappropriate demands.

When state agencies lack the contacts or legislative expertise to effectively deal with the legislative branch, we may assist state agencies in two primary ways:

  1. We support state agencies in their efforts to justify and defend contracts and contractors before the legislative appropriations committees.
  2. We propose favorable legislative action for state agencies and our clients.


Appropriations

In the appropriations process, we lobby both the executive and legislative branches.

  • Efforts directed toward the executive branch include:
    • Recommendations and support for agency appropriations;
    • Support of favorable agency agendas with our clients’ industry expertise; and
    • Identification of contract opportunities for our clients within state agencies.
  • Efforts directed toward the legislative branch include:
    • Support and implementation of funding for items not currently funded; and
    • Prevention of the reduction or elimination of funding for items currently funded.

 

We apply our detailed understanding of the rules by which the legislature operates and knowledge of a legislator’s character and sphere of influence to support and propel our clients’ agenda.

Implementation procedures:

  1. Effectively researching a client’s issues;

  2. Assessing a client’s “political capital;”

  3. Developing a comprehensive plan for success;

  4. Building appropriate coalitions;

  5. Developing legislative and opinion leaders as champions;

  6. Preparing and proposing appropriate legislative action;

  7. Defending against hostile actions; and

  8. Assessing performance and modifying plans accordingly.

In terms of day-to-day activities, we engage in the following services:

Monitor and Analyze

  • Monitor proposed legislation, rules, regulations, policies and procedures that may impact our clients;

  • Monitor interim committees and recommendations which may have an impact on our clients;

  • Monitor meetings and hearings of legislative committees for debate and votes affecting our clients;

  • Monitor legislative sessions when legislation affecting our clients is debated or voted upon; and

  • Monitor the Missouri Register and notify clients of proposed rules that may require clients’ action.


Communicate and Coordinate

  • Meet with clients to discuss their lobbying needs;

  • Attain approval from clients on appropriate positions, verbal and/or written communications;

  • Provide the clients with pertinent information such as hearing schedules and copies of bills;

  • Advise clients of legislative hearings and other meetings requiring clients’ attendance and input;

  • Provide regular reports to our clients regarding legislative developments and activities; and

  • Provide summaries of appropriate hearings, meetings, etc.


Develop and Deliver

  • Develop briefing documents for legislators on key issues relating to clients’ position;

  • Propose modifications to make legislation or regulations more favorable to our clients;

  • Meet with legislators to ensure their awareness of our clients’ position regarding proposed legislation;

  • Arrange meetings with clients and legislators to address issues regarding legislative proposals;

  • Testify and/or serve as clients’ spokesman, openly disclosing the relationship with clients;

  • Networking & socializing with decision makers; and

  • Direct proposed legislative action.

 

LEGISLATIVE BRANCH

Other Statewide Elected Officials

Problems can often be solved most efficiently by utilizing the office of a statewide elected official.

Other than the Governor, statewide elected officials tend to have a very limited technical responsibility. While these office holders may have very narrow authority, they often do, however, have strong force of personality and a very effective bully pulpit. At Flotron & McIntosh, we routinely interface with the Lieutenant Governor, Attorney General, State Auditor, Secretary of State, and various state commissions to which these elected officials are appointed. We understand the specific authorities of each statewide elected official’s office and readily adapt clients’ overall strategy to include the political weight of those offices to achieve our clients’ objectives.
 

Legislative Marketing/Business Development

The state government is the largest purchaser of goods and services in Missouri. We help sell our clients’ goods and services to state government.

State agency bureaucrats can have a great deal of influence on the annual budget and are often the primary source of information for appropriations officials. Additionally, state agencies can become entrenched in obsolete systems that become impractical and inefficient. Consequently, legislators are often unaware of the better options available. At Flotron & McIntosh, we work to convince the bureaucrats to use the superior goods and services of our clients. We help them to look beyond the simple cost to show them the true value of a product or service.
